1. Purpose and Scope

This Acceptable Use Policy ("AUP") defines what you may and may not do with the services of Xponzy Tech LLC ("Xponzy"), including web hosting, email, DNS, and related services. It exists to protect our clients, our infrastructure, and the wider internet. It applies to every client and to every person a client allows to use the services, and it forms part of our Terms of Service. You are responsible for the conduct of your users and of anyone who uses the services through your account.

2. No Illegal Content or Activity

You may not use the services to store, publish, transmit, or link to content or to conduct activity that is illegal under applicable law, including United States law. This includes, without limitation:

  • Child sexual abuse material, which will be reported to the competent authorities;
  • Content that infringes copyright, trademark, or other intellectual property rights;
  • Sale or distribution of controlled substances, stolen data, or counterfeit goods;
  • Content that constitutes harassment, credible threats, defamation, or incitement to violence;
  • Fraudulent schemes, deceptive offers, pyramid schemes, or money laundering;
  • Gambling operations that lack the licenses required in the relevant jurisdictions;
  • Export control violations.

3. No Spam

Unsolicited bulk email is prohibited, whether sent through our infrastructure or sent from elsewhere to promote content hosted with us. When sending email through the services you must:

  • Send commercial or bulk messages only to recipients who have given verifiable consent or with whom you have an existing business relationship, in compliance with applicable law, including CAN-SPAM;
  • Include a working unsubscribe mechanism and honor opt-out requests promptly;
  • Identify yourself truthfully as the sender and use accurate subject lines and headers; forging headers or sender identities is prohibited;
  • Never use purchased, rented, or harvested address lists;
  • Respect any message volume and rate limits applicable to your plan, and coordinate with us in advance for legitimate high-volume sending such as opt-in newsletters.

Accounts that cause our mail infrastructure to be blocklisted may be suspended immediately to protect other clients.

4. No Malware, Phishing, or Fraudulent Infrastructure

You may not host, distribute, or link to malware, ransomware, viruses, spyware, or any code designed to damage or gain unauthorized access to systems or data. You may not operate phishing pages, fake login portals, botnet command-and-control, malicious redirects, or any infrastructure used to deceive or defraud. You may not impersonate any person or organization or misrepresent your affiliation.

5. No Network or System Abuse

You may not:

  • Attempt to access accounts, systems, or data without authorization, or probe or scan systems that you do not own or have permission to test;
  • Launch, participate in, or facilitate denial-of-service attacks;
  • Intercept traffic not intended for you, or spoof network addresses;
  • Run open mail relays, open proxies, or open DNS resolvers;
  • Distribute tools whose primary purpose is to enable the conduct prohibited by this AUP;
  • Use the services to mine cryptocurrency on shared infrastructure.

6. Fair Use of Shared Resources

Shared hosting runs on infrastructure used by many clients at once. Plan limits for CPU, memory, storage, processes, and email volume are stated on the applicable order page. Sustained resource consumption that degrades the experience of other clients is not permitted, even within nominal limits. Shared hosting accounts may not be used primarily as backup or file distribution repositories, for long-running background processes, or for applications that require dedicated resources. If your workload outgrows shared hosting, we will suggest a more appropriate service before taking restrictive measures whenever practical.

7. Reporting Abuse

If you believe a service hosted by Xponzy is being used in violation of this AUP, please report it through our contact form at https://xponzy.com/contact.php or, if you are a client, through the support portal at https://xponzy.com/submitticket.php. Include the URLs or message samples involved and the date and time of the observation. We review abuse reports promptly.

8. Consequences of Violations

Depending on the severity and recurrence of a violation, we may take one or more of the following actions:

  1. Notify you and request correction within a stated period;
  2. Remove or disable access to the offending content;
  3. Suspend the affected service or account, with or without prior notice where the situation reasonably requires immediate action, such as active spam runs, phishing, or malware distribution;
  4. Terminate the service or account for serious or repeated violations;
  5. Report the matter to law enforcement or other competent authorities when required or appropriate, and preserve related evidence.

Fees for periods of suspension caused by AUP violations are not refundable, and violations may void eligibility under the Refund Policy. You remain responsible for fees owed and for any damages caused to Xponzy or third parties, as described in the Terms of Service.

9. Changes and Questions
